WHATS IN THE NEWS?
California Child Victims Act (CA AB-218) in California
In the past, survivors of childhood sexual abuse were bound to a 3 year statute of limitations to file a claim. The California Child Victims Act (CA AB-218) took effect January 1st, 2020. This bill allows survivors to sue until the age of 40 or within five years of discovering the psychological injury caused by the abuse, whichever is later.
Assembly Bill No. 218
CHAPTER 861
An act to amend Sections 340.1 and 1002 of the Code of Civil Procedure, and to amend Section 905 of the Government Code, relating to childhood sexual assault.
Approved by Governor October 13, 2019. Filed with Secretary of State October 13, 2019
"This bill would expand the definition of childhood sexual abuse, which would instead be referred to as childhood sexual assault. This bill would increase the time limit for commencing an action for recovery of damages suffered as a result of childhood sexual assault to 22 years from the date the plaintiff attains the age of majority or within 5 years of the date the plaintiff discovers or reasonably should have discovered that the psychological injury or illness occurring after the age of majority was caused by sexual assault, whichever is later. This bill would also provide for the recovery of up to treble damages against certain defendants in these actions, and would revive time-lapsed claims in certain circumstances."
"There is an expectation that come Jan. 1, 2020, AB 218 (Gonzalez, D-San Diego) — which expands the statute of limitations for filing claims of childhood sexual assault — will result in the filing of many civil actions against school districts and county offices of education. Local educational agencies (LEAs) should prepare themselves to receive childhood sexual assault claims from the past, as well as going forward."

Death of baby decapitated during birth ruled a homicide, medical examiner says
These parents suffered an unimaginable loss when their baby did not survive birth. The devastated couple is suing the obstetrician, Tracey St. Julian, for allegedly applying an excessive amount of force in her attempt to deliver the baby vaginally, leading to the tragic demise. The parents were not allowed to hold their baby, which studies show facilitates the grieving process even when a baby does not survive. Southern Regional Medical Center has denied any wrongdoing, citing that the provider was not an employee of the hospital, they are contracted and have privileges at the facility.
"The Clayton County Medical Examiner’s Office said Tuesday that newborn Treveon Taylor Jr.’s cause of death was a “fracture dislocation with complete transection (to the) upper cervical spine and spinal cord.” His death was caused by shoulder dystocia, arrest of labor and fetal entrapment in the birth canal."
"The lawsuit claims the doctor did not tell the mother and father what had happened. Instead, hospital staff allegedly refused to let them hold the baby after death, the lawsuit claims. They showed the parents Treveon wrapped tightly in a blanket with his head propped on top, a statement said. It also says staff pressured the couple to cremate the remains and told them an autopsy wasn’t warranted."
